In 2014, a new law went into effect requiring that all new residential leases disclose the existence or non-existence of a maintained and operative sprinkler system in the leased premises.
The law, Real Property Law §231-A, additionally requires that if there is an operative sprinkler system, the lease must disclose the last dates of maintenance and inspection.
To meet the minimum requirements of the law, the following statement should be made conspicuously in all new residential leases in boldface type:
The leased premises (choose one of the following) is/is not serviced by a maintained and operative sprinkler system that was last maintained on ____________, 20__ and was last inspected on _______________, 20__.
The above law does not apply to leases that went into effect prior to December 3, 2014. In other words, there is no requirement to amend or modify leases already in existence prior to the effective date of the new law.
